Terms

Using this website, and booking the house.

Last updated 16 September 2026

The short version. Nothing on this site is a booking. Sending an enquiry costs nothing and commits you to nothing. A stay is booked only once we have confirmed it to you in writing, on the terms in that confirmation.

Who these terms are with

Villa Ndoto, Msitu Kwetu, Diani Beach, Kenya. Contact us at villandoto252@gmail.com. These terms cover your use of this website and the basis on which we take bookings for the house.

What the website is

It describes the property and what it is like to stay there. The photographs are of Villa Ndoto itself, not of a show home or a similar property. We keep the descriptions accurate, but the house is a real building on the coast and small details change over time.

Nothing on these pages is an offer capable of acceptance, and no price shown or implied here binds either of us. Availability and rates are confirmed only in a written quotation.

Enquiries are not bookings

An enquiry is a request for a quotation. We reply with a price and whether the house is free on your dates. That quotation is valid for the period stated in it.

A booking exists only when we confirm it to you in writing and any deposit we have asked for has been received. Until both of those have happened, the dates are not held for you.

Rates, deposit and payment

We do not publish rates, because they depend on the season and the length of the stay. The rate for your stay, what it includes, the deposit, the balance, when each falls due and how to pay are all set out in your written quotation and booking confirmation. Those documents, together with these terms, are the agreement between us.

Changes and cancellation

The cancellation and amendment terms that apply to your stay are set out in your booking confirmation. Please read them before you pay a deposit, and ask us if anything in them is unclear. We strongly recommend you hold travel insurance that covers cancellation.

The property and who stays in it

Villa Ndoto is let as a whole to one party. It has four en-suite bedrooms across a main house and a guest villa, and sleeps up to eight people.

The number of people staying must not exceed the number agreed in your booking confirmation. Please tell us in advance if your party changes, so that we can prepare the house properly and confirm whether the change is possible.

Arrival and departure times are confirmed with your booking. Staff live and work on the property and will need reasonable access to it during your stay.

Looking after the house

Please treat the property and its contents with care, and be considerate of the neighbours. The house contains carvings, textiles and other pieces collected over many years, several of which cannot be replaced. You are responsible for loss or damage caused by your party beyond ordinary wear.

The property may not be used for anything unlawful, and it may not be sublet or used for a commercial event without our written agreement.

Activities run by other people

The activities we describe, including dhow safaris, glass-bottom boats and anything else booked through a third party, are run by independent operators. We are happy to point you at the ones we know, and we can help arrange them, but we do not operate them and we are not responsible for how they are run. Your contract for those activities is with the operator.

Liability

Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot lawfully be limited.

Beyond that, we are not liable for loss or damage that was not reasonably foreseeable, nor for events outside our reasonable control, and our liability in connection with a stay does not exceed the total amount paid for that stay. You are responsible for your own belongings. Safes are provided in every bedroom.

Governing law

These terms and any stay booked under them are governed by the law of Kenya, and the courts of Kenya have jurisdiction. If you are a consumer resident elsewhere, this does not remove any protection you have under the law of your own country that cannot be set aside by agreement.

Changes to these terms

We may update these terms. The version that applies to your stay is the one published when your booking was confirmed, and we will send it to you with the confirmation if you ask.
